Senior Associate Justice Antonio Carpio’s views on President Duterte’s approach to the South China Sea dispute will not hurt his chances of becoming the next Chief Justice, according to Mr. Duterte’s spokesperson.

“It doesn’t matter to [the President]. What is important is that [Carpio] is highly qualified for the delicate job of the Chief Justice of the Supreme Court,” Salvador Panelo said.

He added: “The discretion to appoint the Chief Justice lies with the President and he considers all factors in choosing the nominee.”

Panelo made the remarks after Carpio was nominated anew for the position of Chief Justice, to be vacated by Lucas Bersamin on his retirement on Oct. 18.

Carpio’s nomination is his fourth, although he is also set to retire on Oct. 26. He had been bypassed thrice for the position.

Carpio has been very vocal and critical of Mr. Duterte’s handling of the West Philippine Sea territorial dispute, with the President countering with public rebukes against the associate justice.

In a speech last June, Mr. Duterte said, “As I said, ‘You know, Justice Carpio, you are so stupid. That’s why you’ll never get anywhere.’”
