MANILA, Philippines – Vice President Sara Duterte’s impeachment trial enters its 33rd day, with the House prosecution set to present Anti-Money Laundering Council (AMLC) Secretariat Executive Director Ronel Buenaventura as it presents financial records and transactions involving Duterte, her husband Manases Carpio, and their business interests.

Key developments:
- Today’s proceedings form part of of the prosecution’s presentation of evidence for Article II, which accuses Duterte of amassing unexplained wealth and failing to fully disclose her and her spouse’s assets, liabilities and net worth.
- Buenaventura previously appeared before the House committee on justice during its hearings on the impeachment complaints, where he testified about billions of pesos worth of transactions involving Duterte and Carpio.
- The prosecution is expected to use AMLC records to support its case concerning Duterte’s alleged unexplained wealth.

Senator-judge Francis Pangilinan raised concern that the defense’s discussion of possible criminal liability over the disclosure of AMLC records could eventually extend to the senator-judges.
“It leads us to think that maybe in the cross-examination, I don’t know, the defense counsel will raise the issue of the possible criminal liability of the senator judges,” Pangilinan said.
Pangilinan said the Senate presiding officer had already ruled on the issue and suggested that the defense bring any challenge to the Supreme Court.
“If the defense wishes to raise this issue, bring it to the Supreme Court, perhaps,” he said.

Defense counsel Sheila Sison asked the impeachment court to give the defense an “ample and meaningful opportunity” to cross-examine AMLC Executive Director Ronel Buenaventura.
Sison said the prosecution spent the entire day examining the witness, while the defense had only about an hour of cross-examination, and had received the resubmitted AMLC data only over the weekend.
“We cannot be rushed in cross-examining this witness, Your Honor. That will not be fair,” Sison said.
Prosecution counsel Mae Divinagracia maintained that both sides had the same amount of time to review the documents and accused the defense of seeking to end the hearing early.

Defense counsel Mark Vinluan questioned whether rollover transactions could make aggregate figures appear much larger than the actual amount involved.
Using a time-deposit example, Vinluan noted that an amount of around P600,000 could be reported repeatedly as transactions, resulting in a much larger aggregate figure.
Buenaventura confirmed that an AMLC financial intelligence report showed possible monthly time-deposit rollovers from January to September 2022, but said AMLC takes steps to avoid double counting entries appearing in multiple reports.

LOOK: AMLC official Director Ronel Buenaventura told the impeachment court that his testimony on the subpoenaed AMLC reports does not violate the Anti-Money Laundering Act.
Presiding Officer Francis Escudero said the court, after reviewing the records in camera, found no procedural confidentiality that would prevent the AMLC from providing the reports.
Asked if his testimony violated any provision of Republic Act No. 9160, as amended, Buenaventura said: “No, Your Honor.”
Buenaventura acknowledged the law’s confidentiality provisions but said the AMLC’s internal rules allow it to comply with orders from competent courts.
“We are complying with our internal rules, the law, and the order of this court,” he said.
