Court gives Trillanes 5 days to answer motion for departure order, ‘alias warrant’

A LOCAL court presiding over the coup d’etat charges against Sen. Antonio Trillanes 4th gave the legislator five days to comment on a Department of Justice (DOJ) motion for the issuance of a hold departure order and an alias warrant against him.

Judge Andres Soriano of Branch 148 of the Makati Regional Trial Court set the hearing on the motion of the DOJ at 9 a.m. on September 13.

“Accused Antonio Trillanes 4th is given a period of 5 days from the receipt of this order within which to file comment to the motion. Let the motion be set for hearing on September 13, 2018 at 9:00 in the morning,” the order read.

The order was issued on Tuesday afternoon but was only served to the parties involved on Wednesday morning.

Soriano said no arrest warrant would be issued just yet.

Soriano earlier said he still has to review 53 documents on the Oakwood and Manila Peninsula mutinies, some of which he has yet to get from the court warehouse, and until then Trillanes couldn’t be arrested.

“Based on this case I don’t think he would be arrested,” Soriano told reporters on Tuesday.

He said that if government elements would arrest Trillanes without court-issued orders, it would be considered a warrantless arrest unless there is basis.

“There was a previous dismissal, based on the amnesty by the previous judge [who handled the cases],” Soriano said on whether there was a standing warrant of arrest for Trillanes. NEIL JAYSON N. SERVALLOS
