SolGen to ask SC to revoke ABS-CBN franchise

GOVERNMENT lawyers are set to ask the Supreme Court (SC) to revoke the legislative franchise of ABS-CBN media network.

According to unimpeachable sources of The Manila Times, the Office of the Solicitor General (OSG) will file the case before the high court.

The OSG has already finished a draft petition and the case is expected to be filed on Thursday.

The source of Manila Times said a petition for quo warranto is expected to be lodged before the Supreme Court.

Solicitor General (SolGen) Jose Calida is expected to lead his team in the filing of the petition.

Under Rule 66 of the Rules of Court, a legislative franchise may be revoked if there are violations committed by a corporation or entity.

The Manila Times source said the filing of the case was caused by violations of ABS-CBN of the “terms and conditions “ of the franchise granted to them by Congress.

“There were several violations filed by ABS-CBN in their legislative franchise. A petition will be filed before the Supreme Court to revoke its grant,” the source stated.

The source, however, did not give details on the violations.

Another Manila Times source said the solicitor general and the assistant solicitor general have already signed the draft petition of the OSG.

Justice Secretary Menardo Guevarra told The Manila Times that he has already heard about the petition to be filed a long time ago.

Guevarra said he was not aware if the case would be filed immediately by the OSG.
