ICC prosecutors update evidence list in Duterte case, remove 253 items

On 16 September 2026, Trial Chamber III of the International Criminal Court (ICC) held a third status conference in the case of The Prosecutor v. Rodrigo Roa Duterte. Trial Chamber III is composed of Presiding Judge Joanna Korner, Judge Keebong Paek and Judge Nicolas Guillou. (c)ICC-CPIMANILA — The prosecution team of the International Criminal Court (ICC) has updated its list of evidence in the crimes against humanity case against former Philippine President Rodrigo Duterte, removing 253 items following a review.

In a public redacted filing dated October 12, the prosecution said it had restructured its list to provide “a clearer understanding of the categories of evidence the Prosecution seeks to rely upon.”

The updated list, submitted to Trial Chamber III, groups the evidence into seven categories: materials cited in the prosecution’s trial brief, trial witness-related materials, speeches by Duterte and other alleged co-perpetrators, datasets, materials from non-governmental organizations, open-source materials, and other evidence.

The prosecution identified materials cited in its trial brief and annexes as containing the “key items of evidence” in its case.

It noted that the 253 items were dropped following a review conducted after the September status conference.

The prosecution added that it could remove nearly 7,000 more items if the defense agrees to proposed agreed facts concerning a collection of evidence.

The filing also identifies a dataset containing Philippine National Police records related to killings during anti-drug operations and other drug-related deaths covering the period specified in the charges.

According to the document, the prosecution submitted the updated list to the chamber on October 6.

The document was filed confidentially because it contains sensitive information concerning prosecution witnesses and sources, with the version made public containing redactions.

Duterte faces charges of crimes against humanity before the ICC over his administration’s war on drugs. The charges remain allegations to be determined through judicial proceedings.
